In no case shall The World Yin & Yang Centers LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. You agree to indemnify, defend and hold harmless The World Yin & Yang Centers LLC, Chitology and Dr./Grandmaster Shay, our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 – SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 – TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 – ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

RETURNS POLICY

All sales are final. We accept items in return or exchange, for items damaged in transit.

REFUNDS AND EXCHANGES

To be eligible for a refund or exchange, you must first email us at support@theworldyinyangcenters.com to alert us of the damage, then return the damaged item to us. Upon receipt of the damaged item we will ship out a replacement, if available at the given time. If the item purchased returned is not available, you may choose a different item for the same price or request a refund.

Only regular priced items may be refunded. Unfortunately sale items cannot and are final.

SHIPPING

Depending where you may live, the time it may take for your product to reach you may vary. Currently products are shipped in the U.S.A. only.

WAIVER AND RELEASE OF LIABILITY

PLEASE READ THIS AGREEMENT & WAIVER CAREFULLY, AS IT AFFECTS YOUR FUTURE LEGAL RIGHTS. BY SIGNING BELOW, YOU (ON BEHALF OF YOURSELF OR YOUR MINOR CHILD/WARD AND ANY PERSONAL REPRESENTATIVES, ASSIGNS, HEIRS AND NEXT OF KIN) ACKNOWLEDGE, AGREE AND REPRESENT THAT YOU HAVE CAREFULLY READ AND FULLY UNDERSTOOD THIS DOCUMENT AND AGREED TO ITS TERMS. YOU AGREE THAT IF YOU DO NOT ACCEPT ALL OF THE TERMS AND CONDITIONS IN THIS AGREEMENT & WAIVER, YOU SHOULD NOT PARTICIPATE IN THE EVENT/SEMINAR/WORKSHOP/MINI-RETREAT/RETREAT.

This Agreement & Waiver must be carefully read and signed in consideration of being permitted to enter (for any purpose) THE WORLD YIN & YANG CENTERS LLC/ CHITOLOGY/THE WORLD CTE PERSONAL PROTECTION CHAMPIONSHIPS/GLOBAL LIFESTYLE HIGH LIFE EVENTS (“Event/Seminar/Workshop/Mini-Retreat/Retreat”) and associated property (“Premises”). As used herein, the term “Releasees” is defined to include the following: (i) The World Yin & Yang Centers LLC, its subsidiaries, affiliated companies, owners, members, managers, directors, officers, past and present employees, agents, representatives, successors and assigns (collectively, “TWYYC”); (ii) the Premises owner; (iii) any Event/Seminar/Workshop/Mini-Retreat/Retreat staff or volunteers; and (iv) any Event/Seminar/Workshop/Mini-Retreat/Retreat sponsors.

______To the best of my knowledge, I am in good physical condition and fully able to participate in this course. I am fully aware of the risks and hazards connected with the participation in activities associated with THE WORLD YIN & YANG CENTERS LLC, CHITOLOGY, CTE Personal Protection, Qi Gong Power Chi, Qi Gong Power Chi Walking, Elite/Spiritual Sword Programs, Personal Protection 7 Deadly Mistakes to Avoid, Energy Balancing Holistic Cancer Relief Program,  The World CTE Personal Protection Championships, The Universal Chi Mastermind Energy In Motion Success Breakthrough Seminar/Workshops, Takeout Artists, CTE Zombies, Universal Chi Flow Elements & Dimensions Seminar/Workshops, EE-OPPS, Steel Shield, Control & Go, Personal Protection 1/2/3, 911 Home Invasion (Family Home Protection), Anti-Child Abduction, Weapons Disarmament, Security Control and Escort, Risk Management for Executives & Professionals, CTE Inner Circle Personal Protection Body Guarding, CTE Levels 1A-6B, Internal Temple Active/Reflective Meditations, Internal Temple Active Core Healing, including physical injury or even death, and herby elect to voluntarily participate in said event, knowing that the associated physical activity may be hazardous to me and my property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OR LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, or loss or damage to property owned by me, as a result of participation in this course. I further certify that I am at least 18 years of age. If under 18, my parent/guardian is the below signed.

______I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE, The World Yin & Yang Centers, Chitology, DR/GRANDMASTER/YOGI/GURU Shay, their instructors, officers, servants, agents, and employees (hereinafter referred to as RELEASEES) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in physical activity, or while on or upon the Premises where the Event/Seminar/Workshop/Mini-Retreat/Retreat is being conducted.

______I understand and agree that it is my responsibility to determine whether I am (or my child/ward is) in good physical condition, sufficiently fit, healthy and can safely participate in the Event/Seminar/Workshop/Mini-Retreat/Retreat. I certify that I do not (or my child/ward does not) have any physical or mental condition that may affect my (or my child’s/ward’s) ability to safely participate in the Event/Seminar/Workshop/Mini-Retreat/Retreat or would make my (or my child’s/ward’s) participation more hazardous. If I am pregnant, disabled in any way or have recently suffered an illness or injury, I should have or did consult a physician before participating in the Event/Seminar/Workshop/Mini-Retreat/Retreat. I agree that if I am not in proper physical or mental condition on the day of the Event/Seminar/Workshop/Mini-Retreat/Retreat or if I have any questions about my ability to safely participate in the Event/Seminar/Workshop/Mini-Retreat/Retreat, that I will not participate in the Event/Seminar/Workshop/Mini-Retreat/Retreat.

______I understand further that strict observation to the rules and regulations may include the use of protective equipment required in said Event/Seminar/Workshop/Mini-Retreat/Retreat. This equipment will largely eliminate the possibility of accident or injury; however, the above does not warrant the protective equipment. Participants may/will also be using special training bags/ and or dummies and the same as above applies. I understand during the Event/Seminar/Workshop/Mini-Retreat/Retreat, Releasees and/or other participants or authorized persons will be engaged in a course of conduct requiring physical contact, and he/she gives full consent to such contact as is required by the training.

______I agree to observe and obey all posted rules and warnings, to follow any instructions or directions given by TWYYC through its employees, representatives or agents and to abide by decisions of any Event/Seminar/Workshop/Mini-Retreat/Retreat official relative to my ability to safely participate in or attend the Event/Seminar/Workshop/Mini-Retreat/Retreat. I understand and agree that I am expected to exhibit appropriate behavior at all times while at the Event/Seminar/Workshop/Mini-Retreat/Retreat or on the Premises and to obey all local, state and federal civil and criminal laws. This includes, generally, respect for other people, equipment, facilities or property. TWYYC may dismiss me, without refund, should my behavior endanger the safety of or negatively affect the Event/Seminar/Workshop/Mini-Retreat/Retreat, Premises or any person, facility or property.

______I consent to the use of my (or my child’s/ward’s) name, image and/or likeness in photographs, videos or recordings taken at the Event/Seminar/Workshop/Mini-Retreat/Retreat for use in Event/Seminar/Workshop/Mini-Retreat/Retreat advertising, marketing or promotion and I waive all right to any future compensation to which I may otherwise be entitled as a result of the use of such likeness. I assign to TWYYC all rights, title, and interest in any photographs, videos, or other records that I take at the Event/Seminar/Workshop/Mini-Retreat/Retreat; TWYYC grants to me a limited, non-exclusive right and license to use such records for non-commercial purposes only. I understand and agree that all entry fees and related purchases are final and non-refundable. I understand and agree that TWYYC reserves the right to cancel the Event/Seminar/Workshop/Mini-Retreat/Retreat due to weather (including, but not limited to, heat, storms, lightning, floods or tornadoes), accidents, acts of war or terrorism, military conflicts or riots or for any reason that will affect the safety and security of Event/Seminar/Workshop/Mini-Retreat/Retreat participants and attendees. In the event of such cancellation, there will be no refund of my entry fee or related purchases.

______I understand and agree that the Releasees are not responsible for any personal item or property that is lost, damaged or stolen at the Event/Seminar/Workshop/Mini-Retreat/Retreat or on the Premises. I understand and agree that pets, strollers or other wheeled means of conveyance are not permitted on the Event/Seminar/Workshop/Mini-Retreat/Retreat course. I understand and agree that I may not bring weapons, fireworks or illegal substances to the Event/Seminar/Workshop/Mini-Retreat/Retreat or the Premises or sell unauthorized merchandise at the Event/Seminar/Workshop/Mini-Retreat/Retreat or on the Premises. Failure to abide by these or other rules published by TWYYC may result in my dismissal from the Event/Seminar/Workshop/Mini-Retreat/Retreat without refund.

______I agree not to consume alcohol or use any medicine or substance (unless prescribed by a doctor or physician) prior to or during the Event/Seminar/Workshop/Mini-Retreat/Retreat that will inhibit my mental or physical ability to safely participate in the Event/Seminar/Workshop/Mini-Retreat/Retreat. If I choose to consume alcoholic beverages after the Event/Seminar/Workshop/Mini-Retreat/Retreat, I will do so responsibly and only if I am over the age of twenty-one (21).

______I consent to first aid, medical care and/or transportation in order to obtain treatment in the event of injury to me as the Releasees or medical professionals may deem appropriate and I understand that this Agreement & Waiver extends to any liability connected with such treatment or transportation. I understand that it is my responsibility to obtain any insurance necessary to cover injuries or medical costs I may incur at the Event/Seminar/Workshop/Mini-Retreat/Retreat, and I certify that on the day of the Event/Seminar/Workshop/Mini-Retreat/Retreat I will be covered by such insurance. I agree to assume liability for any medical costs incurred as a result of my participation in the Event/Seminar/Workshop/Mini-Retreat/Retreat and agree to indemnify and hold harmless the Releasees from all liability for such costs.

______I agree to indemnify and hold harmless the Releasees from and against all suits, actions, legal proceedings, claims, demands, damages, judgments, liabilities, interest, attorneys’ fees, costs and expenses of whatever kind or nature (collectively, “Claims”) directly or indirectly caused by any act or omission of the Releasees or others (including Event/Seminar/Workshop/Mini-Retreat/Retreat attendees) while I am (or my child/ward is) at the Event/Seminar/Workshop/Mini-Retreat/Retreat or on the Premises, regardless of whether or not I am (or my child/ward is) participating in the Event/Seminar/Workshop/Mini-Retreat/Retreat at the time and regardless of whether or not caused by or alleged or claimed to be caused by the active or passive negligence of the Releasees.

______It is my expressed intent that this release and hold harmless agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a RELEASE, WAIVE, DISCHARGE, and CONVENTION TO SUE the above named RELEASEES.

______I understand, acknowledge and agree that the laws of the state shall apply to all matters relating to this Agreement & Waiver regardless of the Event/Seminar/Workshop/Mini-Retreat/Retreat location.

______I understand and agree that this Agreement & Waiver constitutes the entire agreement between the parties relating to the subject matter hereof, is a contract that shall be binding to the fullest extent permitted by law and is intended to be as broad and inclusive as permitted by the law. If any part of this Agreement & Waiver is deemed to be unenforceable, the balance shall continue in full legal force and effect.

In electronically signing this release, I acknowledge and represent that I HAVE READ THE FOREGOING Waiver of Liability and Hold Harmless Agreement, UNDERSTAND IT AND ELECTRONICALLY SIGN IT VOLUNTARILY as my own free act and deed; no oral representations, statements or inducements, apart from the foregoing written agreements have been made; I understand that I am giving up substantial legal rights by signing below, including the right to sue the Releasees; and I EXECUTE THIS RELEASE FOR FULL, ADEQUATE AND COMPLETE CONSIDERATION FULLY INTENDING TO BE BOUND BY SAME.

This Liability and Release Waiver is hereby agreed to once any account is activated.

RECURRING PAYMENT AUTHORIZATION

You’re authorizing online regularly scheduled charges to your checking/savings account or credit card. A receipt for each payment will be emailed to you and the charge will appear on your bank statement as “The World Yin & Yang Centers.” You agree that no prior-notification will be provided unless the date or amount changes, in which case you will receive notice from us at least 10 days prior to the payment being collected.

You understand that this authorization will remain in effect until you cancel it in writing, and you agree to notify The World Yin & Yang Centers LLC in writing of any changes in my account information or termination of this authorization at least 15 days prior to the next billing date. If the above noted payment dates fall on a weekend or holiday, you understand that the payments may be executed on the next business day. For ACH debits to my checking/savings account, you understand that because these are electronic transactions, these funds may be withdrawn from my account as soon as the above noted periodic transaction dates. In the case of an ACH Transaction being rejected for Non-Sufficient Funds (NSF) I understand that The World Yin & Yang Centers LLC may at its discretion attempt to process the charge again within 30 days, and agree to an additional $25.00 charge for each attempt returned NSF, which will be initiated as a separate transaction from the authorized recurring payment. You acknowledge that the origination of ACH transactions to my account must comply with the provisions of U.S. law.  You certify that you are the authorized user of this credit card/bank account and will not dispute these scheduled transactions with my bank or credit card company; so long as the transactions correspond to the terms indicated in this online authorization form.

All sales are final and by proceeding with the online transaction, you understand these terms and conditions.

IN WITNESS WHEREOF this Agreement is entered into and its contents are fully attested to by the individual’s account activation.
